Family court clerks dept. in court of appeal

Department's Terms of reference:
The Department consists of three controllers and a number of sections, employs a sufficient number of staff and is headed a Director, who reports to the the Assistant Undersecretary for the Affairs of the Palace of Justice.
The Family Court Appeal Books Department operates under the supervision of the Managing Counsel for the Presidency of the Court and is entrusted with the following:
1.Implementation of the general policy of the Department and monitor the application of the rules and regulations governing the conduct of work in the various Department's controls, sections and divisions.
2.Preparation and adoption of judicial statistics.
3.Enforcing the Decrees issued by court circuits.
4.Developing the general plan for periodic leaves of the Department's staff.
5.Preparation of circulars concerning the organization of the administrative work.
6.Adoption of signatures affixed on the judgments' executive copies.
7.Organizing the Department's staff files and receiving the requests relating to their jobs; e.g. leaves, performance evaluation reports and others.
8.Coordination with the Department of Administrative Development, Training and Planning on the field training for the staff nominated by the Department.
9.Recording of the certificates issued by the court (judgements' wording certificates – court ruling certificates) in the register prepared for that purpose, keeping copies thereof and handing them over to the concerned parties.
10.Other relevant works assigned to the Department.

The organizational structure of the Department consists of the following controls:
•Monitoring the Family Court Book at the Court of Appeal in the Capital and Hawally governorates.
•Monitoring the Family Court Book at the Court of Appeal in the governorates of Ahmadi and Mubarak al-Kabeer.
•Monitoring the Family Court Book at the Court of Appeal in Farwaniya and Al-Jahra governorates.

Each Control, within its spatial scope, shall have the following functions:
1.Determine the circuit for the appeals' declarations submitted by lawyers.
2.Editing appeals' declarations which the concerned parties request to submit, specifying the circuit.
3.Receiving and recording appeals' declarations, recording them under the numbers assigned to them.
4.Preparing appeals' files and handing them over to the secretaries of the hearings.
5.Follow up the distribution of cases to the court circuits, following the relevant instructions.
6.Declaring all judicial papers in the appeals held before the court.
7.Distribution of all declared papers to the competent secretaries, through the records prepared for the purpose, in addition to preparing the statistics.
8.Preparation of the appeals' lit for each hearing.
9.Carrying the hearings forward and computerizing the judgements and ruling wording immediately after the hearing.
10.Printing out the judgements according to their order of receipt, taking into account the dates scheduled for the appeals, recording and returning them to the secretaries of the hearings once printed.
11.Receiving the cases that have been sentenced and deleted and archiving them in coordination with the Central Archives Department in accordance with the established rules, taking into account the period assigned for destructing the cases.
12.Delivery of the final judgements to the concerned parties after adding a replica of the writ of execution.
13.Receiving all auditors and executing their applications.
14.Follow-up requests for the gathering of entries, delivering them to and receipt by secretaries.
15.Other relevant work assigned to the Department.

Each Control consists of the following sections:
Lawsuits Officers Section, entrusted with the following:
1.Determine the circuit for the appeals submitted by the of lawyers.
2.Editing appeals' declarations that the concerned parties request to submit, determining the circuit.
3.Preparation of the statistics of the issued declarations.
4.Other relevant work assigned to the Section.

Schedule Section, entrusted with the following:
1.Receipt of appeals' declarations, recording them under the number assigned for them.
2.Preparing appeals' files and handing them over to the secretaries of the hearings.
3.Delivering the original appeals' declarations to the Announcement Sections.
4.Issuing the certificates of the appeals data recorded in the records.
5.Issuing statistics on the number and type of appeals, as well as their distribution to the various circuits.
6.Follow-up the distribution of cases to the court circuits, adhering to the the instructions followed in this regard.
7.Other relevant works assigned to the Section.

Secretariats Section, entrusted with the following:
1.Receipt of new appeals' files transferred from the Schedules Section.
2.Receipt of appeals' declarations completed by the Announcement Section.
3.Receipt of appeals files received from the Experts Department.
4.Preparation of the appeals roll for each hearing.
5.Enforcing the decisions issued by the Court.
6.Sending judgments' drafts once received from the counselors to the Printing Sections.
7.Archiving judgment files upon judgment issuance or cancellation after the elapse of the legal period assigned for renewing them, in preparation to sending them to the Archiving Section or to the Judicial Fees Department, according to the placed procedures.
8.Issuing the certificates on demand from the appeal file.
9.Carrying the hearings forward and computerizing the wording of the judgement immediately after the hearing.
10.Other relevant works assigned to the Section.

Announcement Section, with the following:
1.Declaring all judicial papers in appeals held before the court.
2.Validating all information published in the announced declarations.
3.Distribution of all announced papers to the competent secretaries through the records prepared for the purpose, preparing the relevant statistics.
4.Other relevant works assigned to the Section.

Printing Section, entrusted with the following:
1.Receiving judgments' drafts from the hearings' secretaries, recording them in special records.
2.Printing out the judgements according to their order of receipt, taking into account the dates scheduled for the appeals, recording and returning them to the secretaries of the hearings once printed.
3.Prints the letters, circulars, resolutions, etc. as received by the Section, in addition to other printing works.
4.Other relevant works assigned to the Section.

Follow-up and Circulated Documents Section, entrusted with the following:
1.Receiving all control auditors and implementing their requests.
2.Filing the applications addressed to the heads of circuits, handing them over to the concerned secretaries (from filed notes, renewal requests from cancellation, permits, etc.).
3.Receipt of files issued and received from third parties to/from secretaries.
4.Follow-up the application for requests to gather entries to receive/deliver them to the secretaries.
5.Extracting the authorized permits from the circuits.
6.Uploading a copy of the appeal declaration, as well as the payment receipt of the bail of appeal and the judgment of first instance for the new files recorded in the schedule by scanning.
7.Receipt, sorting out and scanning/uploading the documents presented in the daily hearing, from the minutes of the hearings, the briefs and documents' portfolios.
8.Receipt of the files of the settled appeals, sorting out their relevant papers and document and uploading by scanning.
9.Determining the type and number of the documents submitted in the daily hearings and in the files of the settled appeals, scanning and uploading the submitted documents, so that the number of the actual papers shall correspond to the uploaded number of scanned documents.
10.Other relevant works assigned to the Section.

Archives Section, entrusted with the following:
1.Receipt of settled and written off cases, archiving them in coordination with the Central Archives Department subject to the established rules, taking into account the period assigned for destructing the cases.
2.Delivery of the final judgements to the concerned parties after adding a replica of the writ of execution.
3.Delivery of the documents filed in the cases to their owners, in accordance with the applicable rules.
4.Sending the files kept for five years to the Central Archives Department in accordance with Ministerial Decree No. 180/2014.
