Department Terms of Reference
1.Receive visitors, complete the forms with the details of their social problem, through the marriage contract – divorce contract- resumption of marriage certificate, and open a file for each case which shall be registered in the records prepared for this purpose and enter their data in the computer.
2.Provide an initial description of each problem and refer it to the counsel or concerned social researcher. 
3.Follow up the cases of reconciliation by providing the appropriate advice to them, in order to remove the remaining disagreements or ideas in connection with the divorce.
4.Transfer the Department visitors in the morning shift to the Reform Centre during the evening shift for psychological, social and legal follow up , whether in the event of reconciliation or divorce, and obtain the required legal advices, and authenticate mutual contracts and agreements between them after informing them of the matters which may be authenticated and their execution method through the concerned authenticator in the Authentication Department. 

The Family Counselling Department undertakes its terms of reference under supervision of the Department manager who is entrusted with undertaking the following functions: 
1.General supervision over all the Department personnel, as well as advisors and family disputes experts, control the implementation of the rules and regulations regulating the progress of its work, and execute the general policy of the Ministry. 
2.Lay down the required administrative and technical plans for the development of work in the Department and following up their execution, in coordination with the Administrative Development, Training and Planning Department. 
3.Approval of the Department requirement applications and contact the concerned bodies in the Ministry to provide them.
4.Express the opinion on the employees appointed in the Department, in coordination with the Administrative Affairs Department. 
5.Hold periodical meetings with the personnel in the Department in order to guide them to the proper progress of work. 
6.Represent the Department internally and externally in the conferences, seminars and protocols of cooperation with the relevant bodies. 
7.Manifest the Department’s role and goals and raise cultural awareness in the society about the family field, in coordination with the concerned bodies. 
8.Approve the confidential reports of the Department personnel and lay down the recommendations for their promotion and giving incentives to them, in coordination with the concerned bodies in the Ministry. 
9.Approve the reports and recommendations concerned with family cases which have been investigated by the Department specialists. 

Ministry of Justice Organizational Chart
The Secretarial Section and Legal Counselling Section are directly accountable to the  Department manager in the following manner: 
oSecretarial Section, specialized with the following: 
1)Follow up all the administrative works relevant to the personnel working in the Department, such as supervision of the official working hours, procedures for their leaves and employment status, etc., and assign a file for each employee. 
2)Supervise the attendance of counsels and experts and prepare the statements of their financial dues.
3)Prepare annual reports of the Department’s works.
4)Follow up the five  year operational plans of he Department.
5)Prepare the disbursement of store materials applications for stationary, etc., and disburse them to the Department employees as needed. 
6)Undertake all the typing and photocopying works of the Department.
7)Receive all the letters and correspondences incoming to the Department and register them, then present them to the Department manager to take the required actions towards them, and retain them in the files prepared for this purpose.
8)Export all the correspondences of the Department to the receivers, after recording them, and keep copies thereof in files prepared for this purpose.
9)Keep the Department documents and retrieve them when needed.
10)Receive the complaints from those concerned, examine and reply to them.

oLegal Advices Section, specialized with the following: 
1)Receive visitors, complete the legal application form with their details through the marriage –divorce or resumption of marriage contract of the applicant.
2)Transfer the applicant to the legal advisor- specialized legal researcher to reply to his inquiries. 
3)Clarify the legal and Shariah rights and duties resulting from the marriage and divorce contracts for each party towards the other party and towards the children, according to the provisions of the personal status law.
4)Register the application forms in the register prepared for this objective, and enter them into the computerized system.
5)Submit a periodical statistic to the controller on the works completed by the Section.
6)Contribute in drafting and following up the agreement contracts made by the Department legally in coordination with the Authentication Department.
7)Cooperate with the different sections of the Department and furnish them with the legal opinion to assist them to perform their tasks efficiently according to the Ministry of Justice organizational chart.
8)Express the legal opinion on the matters presented to the Department by the applicants. 
9)Contribute in providing courses in favour of the Department personnel and the applicants in connection with the personal status law, in coordination with the competent authorities.
10)Contribute in making the media releases of the Department “brochures – information booklets-etc.” in coordination with the concerned authorities.
11)Coordination with the Coordination and Follow Up Section in connection with the mechanism of cooperation with the General Department for Execution in connection with transferring and receiving the cases transferred by it and submit reports in this respect.
12)Follow up the marriage relationship parties’ execution of the mutual contract clauses.
13)Submit a periodical statistic to the controller concerned with the works which have been achieved. 

•The Family Disputes and Social Research Control is specialized with the following: 
1.Receive visitors and reply to their phone inquiries as well as assist them to find amicable solutions to their problems. 
2.Prepare a detailed report on each investigated case, supported with the recommendation of the researcher who researched the case. 
3.Follow up the cases of reconciliation and submit the necessary advice to them.
4.Inform the applicants of the dates of attending to meeting the social or psychological researcher or the advisor.
5.Express the legal opinion on the matters presented to the Department. 
This Control has four sections in the following manner: 
oReception and Social Research Section, specialized with the following: 
1.Receiving applicants and completing forms with their social problem data.
2.Open a file for each case and record it in the records prepared for this purpose,  enter its data on the computer, and then refer the file to the relevant social researcher.
3.Coordinate and organize the entry process of applicants.
4.Receiving telephone inquiries regarding the Department's responsibilities and responding to them.
5.Prepare a daily plan that includes working procedures with the public and consultants.
6.Provide a description and initial adaptation of each problem and then forwarded to the concerned consultant or social researcher. 
7.Helping applicants to find amicable solutions to their family problems.
8.Follow-up cases that started with a divorce transaction and did not complete the procedures, post-divorce cases, organizational chart of the Ministry of Justice.
9.Follow-up cases of reconciliation by providing appropriate advice to them to remove the remaining differences or the idea of divorce.
10.Prepare the necessary reports for each case, the results of researching it and the notification of the concerned parties with the same. 
11.Refer the file to the Research and Information Section after finishing searching the problem presented to enter the search result into the computer and save it
12.Submission of statistical and periodic reports to the Controller on the Section works. 
oMarriage Awareness and Guidance Section, which is concerned with the following:
1.Meet the parties to the marital relationship and introduce them to the importance of marriage, its purpose in terms of religion and the society, and how the marital interaction based on affection, understanding and mutual respect and the rights and duties of each party towards the other and towards the home and children and the distribution of responsibilities.
2.To provide the parties with sufficient information on the importance of choosing their partner and what conditions should be met by each party.
3.Definition of the parties to the marital relationship with the steps of marriage from the engagement to the completion of marriage and the objectives and conditions of each step. 
4.Awareness of the parties to the marital relationship of the marital differences expected to occur at the beginning of their lives and how to prevent them and treatment at the time with a statement of types and the basis of treatment and how to reach marriage conformity between them.
5.Working to help the parties to acquire the skills of dealing with each other and solve their problems and responsibilities, in addition to the development of motivation towards work and sacrifice for the family and children ... etc.
6.Cooperation with the Research and Information Section on the work of introducing the parties to the marital relationship for the newly married in training courses for training on the skills of dealing after marriage, in coordination with the competent authorities.
7.Provide statistical and periodic reports to the controller on the works of the Department.
oFamily Dispute Resolution Section, which specializes in:
1.Coordination with the clerks department in the Court of First Instance, Court of Appeal and district courts on the mechanism of cooperation between them.
2.Receipt of files relating to cases referred to the Department by the Clerks Department of the Court of First Instance, Court of Appeal and district courts and set a date for transferring them to the competent expert. Organizational chart of the Ministry of Justice
3.Establishment of a roster of experts names and the day allocated to each one of them.
4.Preparation of a register of cases referred to the Department for enumeration and scheduling of each to interview the family expert.
5.Prepare a special report on each case examined, and keep a copy of it and then register it in the register for this purpose, in preparation for its transfer to the competent clerks department to take the necessary action. 
6.Coordinating with the Department of Notifications about the mechanism of delivery and receipt of notifications.
7.Scheduling appointments for the parties to the interview to meet the competent expert.
8.Provide the Secretarial Section of the Department with the statement of the attendance of experts to calculate the remuneration allocated to each of them and send it to the concerned authority in the Ministry.
9.Issue periodic reports and statistics on the Section and submit them to the controller. 
10.Provide the Research and Information Section with periodic statistics on the achievements of the Section for inclusion in the general report of the Department (quarterly, semi-annual and annual).
11.Contribution to some publications of the Department (brochures, booklets) regarding the work of the Section.
o Notifications Section, concerned with the following:
1.Prepare lists of the names of the notifications representatives and their respective areas. 
2.Receipt of notifications from the Reception and Social Research Section and the Family Dispute Resolution Section to be delivered to the concerned parties.
3.Receipt of guidance notifications from the applicants and schedule their guidance dates and deliver them to the concerned parties.
4.Ensure that the notification representatives deliver the notifications to the area police station in the event of absence of any person in the house of the notified person, and state the reasons. 
5.Ensure that the notification representatives complete the preparation of the notification by registered mail to the concerned parties in connection with the notifications notified by the police station and complete their details.
6.Deliver the relevant sections with the notifications that were delivered to the concerned parties after registering them in a special register and entering their data in the automated system.
7.Prepare daily statistics of the work carried out by the notifications representatives and submit them to the controller.
8.Ensure that the notifications representatives return the notifications that have not been delivered to the concerned parties to concerned section in case the address is incorrect and the reasons are stated.

•External Divisions Control
 It consists of two sections and five offices (each of a section level), as follows:
oResearch and Information Section, specialized in the following:
1.Preparation of researches and studies on divorce and reconciliation.
2.Complete the documents for each file, organize and arrange the files in a sequential order and keep them.
3.Follow up files with consultants.
4.Feed the computer with the necessary data for each case and update the data for cases under follow-up.
5.Develop an information strategy to highlight the role of the Department, its objectives and achievements, in cooperation with the Ministry Public Information and Public Relations Department.
6.Follow-up and update the topics of the page of the Department on the Internet as well as all issues in the media matters related to the work of the Department and prepare a register in which a copy thereof is enclosed. 
7.Coordinating with the concerned authorities at all levels of the State in order to prepare seminars and meetings and supervise their implementation and work on exchanging experiences.
8.Issuing periodic and non-periodic bulletins on all the Department ‘s activities to raise family awareness between the different segments of the society and inform them of the risks and damages of divorce, in particular, socially, economically, psychologically and legally, in coordination with the Media and Public Relations Department. 
9.Furnish the Department library with the books relevant to its work, and undertake the services of reviewing and lending books to those interested in the family affairs. 
oCoordination and Follow Up Section, specialized with the following: 
1.Receive the files of the cases referred to the Department by the Execution Department, schedule a date for them to transfer to the evening shift and refer them to the concerned consultant to investigate the case. 
2.Coordination with the Social Research Section in the head office and external branches of the Department to furnish them with the forms of the Department applicants on timely basis.
3.Transfer the Department applicants during the morning shift to the Reform Centre in the evening shift for psychological, social and legal follow up, whether in case of reconciliation or divorce and obtain the required legal consultations and authenticate the mutual contracts and agreements made between them after informing them of the matters which may be authenticated and how to execute them through the concerned authenticator in the Authentication Department. 
4.Follow up of the cases referred from the morning shift to the evening shift, to ensure reaching the desired goal. Organizational chart of the Ministry of Justice.
5.Receiving a report on the cases referred to the Department by the Execution Department, submitted by the concerned consultant with the investigation of the case, taking a copy of the report and registering in a register for this purpose, then transfer it to the controller in order to transfer it to the Execution Department for taking the required action.
6.Coordination with the Ministry Information Systems Centre to provide a computerized system for connection between the main centre of the Department in Raqqi Courts Complex and the external divisions in the governorates, as well as the Reform Centre (evening shift)
7.Issuing periodical reports and statistics on the Section’s works and the Department divisions in the governorates, as well as the Reform Centre, and submit them to the controller.
8.Coordination with all the Department sections to furnish the section with the required data and statistics.

Each of these offices shall have the same terms of reference and tasks mandated to the main Department in Raaqi Courts Complex, but within the spatial boundaries of its governorate, as per the residence place of the applicants confirmed in their civil identity cards. ​
