KUNA: The Yemeni Minister of Justice Dr. “Ghazi al-Aghbari” arrived Kuwait yesterday on an official visit in response to an invitation from the Minister of Justice, Awqaf, and Islamic Affairs “Hussein Al-Hariti”. The Yemeni Minister said that he conveys a written letter from the Yemeni Prime Minister “Ali Mujur” to His Highness the Prime Minister Shiekh Nasser Al-Mohammad concerning the various cooperative aspects between both countries. Upon arriving Kuwait yesterday, “al-Aghbari” stated that his visit being conducted within the framework of bilateral judicial and legal cooperation that started last year. The Yemeni Minister praised the growing relations between his country and Kuwait on all levels, in particular the judicial and legal level, calling for promoting and developing them. On his part, the Minister “Al-Hariti” welcomed this visit considering it as an embodiment of the brotherly ties and a consolidation of the constructive cooperative relations between both countries. Al-Hariti said that the Judicial Agreement, concluded between both countries, is considered the cornerstone of building cooperation both legally and judicially which contributes to facilitating the litigation procedures before courts in both countries.

     The Minister of Justice, Awqaf, and Islamic Affairs “Hussein Al-Hariti” receives today evening at Kuwait International Airport his Yemeni counterpart Dr. “Ghazi al-Aghbari” heading a high-level judicial and legal delegation to tackle some topics, on top of which, the judicial and legal cooperation between both brother countries and optimizing it, in particular exchange information and field visits on both judicial and legal levels. In a press statement, the Minister “Al-Hariti” asserted, on occasion of this visit, that this visit underlines the deep brotherly relations between State of Kuwait and the sister Republic of Yemen and consolidates ties in the judicial and legal field; it also gives the opportunity to consult the competent authorities on both sides concerning how both countries can benefit and support each other in respect to their judicial apparatuses’ experiences. During this visit, some meetings will be held, on top of which, a meeting with the President of the Supreme Judicial Council, President of Court of Cassation and Constitutional Court, Justice “Rashid Al-Hammad”; the President of Court of Appeal, Justice “Faisal Al-Morshid”; the President of Court of First Instance, Justice “Khalid Salem” along with some of MOJ top officials. Moreover, a widened session of talks will be held headed by both the Minister “Al-Hariti” and his counterpart Dr. “al-Aghbaei”.        The Ministry of Justice “MOJ” formed two committees, one for organization and the other for supervision, concerned with the symposiums which its various Departments suggest to convene as of next February. The Lawful Authentications Department at MOJ will organize a symposium entitled “be kind towards women” where Sheikh Saud Al-Shoraim will be the guest to discuss the lawful and legal matters related to matrimony, the various rights of married and divorced woman and treating woman in conformity with Muslim Law “Sharia” and the supporting laws. In addition, the National Committee for International Human Law will also organize a symposium entitled “International Criminal Court…Reality and Challenges” to discuss legal topics relevant to the charter of International Criminal Court “ICC” and suggesting that Kuwait may be a member of “ICC”. The third symposium, suggested by the Higher Committee of Human Rights, will deal with workers and maids’ human rights and employers’ commitments towards them through raising the awareness of the attendees on these human rights and duties that employers should observe. Through organizing these symposiums, MOJ aims to let all men of society participate and to discuss and highlight the issues of their interest in order to get clear and better understanding which, in turn, will not allow these issues to be handled at courts.

    Al-Rai Newspaper” came to know that Justice “Rashid Al-Sharah” was nominated to take the office of vice-president of the Court of Appeal which became vacant as Justice “Kazem Al-Mazedi” retired. It is worth mentioning that Justice “Al-Sharrah” is a member of the Supreme Judicial Council as being the oldest justice. According to Al-Rai’s sources, Justice “Saleh Al-Hariti” will replace Justice “Al-Sharrah” to be a new member of the Supreme Judicial Council.

       The Ministry of Justice “MOJ” announced that the Yemeni Minister of Justice Dr. “Ghazi al-Aghbari” will visit Kuwait next Mondays heading a high-level judicial and legal delegation on a several days visit. Through his visit, the Yemeni Minister of Justice will hold a meeting with his Kuwaiti counterpart Minister of Justice, Awqaf, and Islamic Affairs “Hussein Al-Hariti” as they will tackle some topics included in the agenda, on top of which, the judicial and legal cooperation between both countries, exchange information and field visits, consolidation of relations between both countries, the matter which allows to learn about judicial experiences as well as the judicial habilitation and training on both sides. According to MOJ, the Yemeni Minister will hold several meetings with the President and members of the Supreme Judicial Council and widened talks attended by the members of the Yemeni judicial delegation and some of the top officials at the MOJ as they will discuss the judicial and legal cooperation protocol and consult the competent authorities on both sides concerning such protocol and how to optimize it. The Yemeni judicial delegation includes the member of the Supreme Judicial Council and the Dean of the Higher Judicial Institute Dr. “Yehia Al-Gerafy”, Judge “Sahl Hamza”, the President of Southern Amanat Court, “Loi’ey Al-Wazer” the Courts’ Director, General, and the Judiciary assistant officers as well as and Deputy- Director, General of the Bureau of the Minister of Justice Mr. “Amin Al-qata’a”.

     The Minister of Justice, Awqaf, and Islamic Affairs, the Justice “Hussein Al-Hariti” issued a ministerial Decree on adding new competencies to some of the assistant under-secretaries at MOJ “Ministry of Justice”. The Decree commissions the Assistant Under-Secretary of Court Supporting Affairs Department to exercise the competencies of the Assistant Under-Secretary of Expert Department; the Assistant Under-Secretary of International Relations Department to exercise the competencies of the Assistant Under-Secretary of Information and Civil Service Centers Department; the Assistant Under-Secretary of Administrative and Financial Affairs Department to exercise the competencies of the Assistant Under-Secretary of Information Technology and Statistics Department. Well-informed sources asserted that the Minister Al-Hariti has to issue this Decree in order to maintain the course of work within those departments that have no under-secretaries, whose names are about to be approved but the political instability in the State and the resignation of the Government prevented their appointment.

    His Highness the Crown Prince Sheikh Nawaf Al-Ahmad Al-Jaber Al-Sabah received in his Diwan at Seif Palace yesterday morning His Highness Prime Minister Sheikh Nasser alMohammad. H.H. the Crown Prince received also the former Speaker of the National Assembly (the Parliament) Mohammad Youssef Al-Adsani, and also received the Minister of Justice, Awqaf, and Islamic Affairs Hussein Nasser AL-Hariti. H.H. also received Dr. Abdel Rahman Abdulla Al-Awadi and his wife Dr. Sedikah Ali Al-Awadi on the occasion that they both won equally the "Sheikh Hamdan Bin Rashid AlMaktoum Award for Specialized Medical Sciences", awarded to scientists and researchers in the Arab nation. H.H. the Crown Prince received also Dr. Eid Faleh Al-Adwani who presented to H.H. a copy of his doctorate dissertation entitled "Evaluating the Policies and Programs of Restructuring the Administrative Organs in Kuwait"- and then H.H. the Crown Prince thanked him and expressed him his hope for success and good fortune.

       The Administrative Affairs Section of MOJ issued an administrative directive to obligate all MOJ employees to apply the fingerprint system, being tested till the end of the current month, in attendance and leaving, while to continue to seal cards. The directive underlined that the Administrative Affairs Section should take all administrative actions related to attendance and leaving, including delays, absences, sick leaves, and official tasks. The directive explained how to use the finger print system, as each employee to enter his own file number, which has been previously set by the Information Systems Section, then to enter F1 on attendance, F2 on leaving, and finally to enter fingerprint. It is worth mentioning that the Administrative Affairs Section considers the possibility to make an exception of some employees, in particular the Foreign Relations Section and Public Relations&Information Section, whose posts require flexibility in attendance and leaving as they are committed to receive official delegations and continuously go out. The reactions of the employees varied on such system, as some of the dissenting opinion think that it affects health according to some world repots; others support the system and think that it will put an end to employees’ truancy

    In cooperation with The General Secretariat of Awqaf Ministry, MOJ organized the respectively Fifth Annual Qur’an Memorization Competition at the state-owned Grand Mosque. More than one hundred contestants from MOJ’s employees performed the tests; the total number of contestants was (102), (25) female and (77) male. The Competition continued till last Wednesday through the test committees, headed by D/Waleed Al-Ali, Imam and Preacher of the state-owned Grand Mosque, divided into four committees for males, and two for females and formed from the Qur’an memorizers from the Ministry of Awqaf and Islamic Affairs. The Director of the Court of Appeal’s Clerks Department, Eiyad Al-Abidan attended the tests along with the General Coordinator of the competition, Abdulla Al-Kandry and the competition’s Supervisor, Mubarak Al-Dosary who belong to the Information and Public Relations Department. There were also employees from Al-Adl (Justice) Palace, the court complexes in different provinces, and various sectors of the MOJ who competed in this faithfully organized competition. D/Waleed Al-Ali praised MOJ whose employees hold the honor of taking care of Qur’an, whether in memorizing or reciting. Al-Ali added that such competition has an apparent impact in purifying souls and implanting virtue within them. By this competition, the MOJ introduced a good practice and it is hopefully that all governmental and private bodies would follow suit in order to establish such useful activities. In addition, the MOJ will organize subsequently an extensive ceremony to award the winners under the auspices of the Under-Secretary of MOJ, the Justice “Soltan Borsely”. However, MOJ divided this competition into four levels represented in memorizing (two Juz’- one Juz’- half of Juz’- quarter Juz’) as well as five positions for each of the four levels.

     The Minister of Justice, Awqaf, and Islamic Affairs, the Justice “Hussein Al-Hariti”, will meet his Yemeni counterpart and the accompanying judicial delegation on the Fifth of next January in order to finally sign a judicial and legal cooperation agreement between both countries. It is worth mentioning that the former Minister of Justice visited Yemen last January and preliminary signed the said agreement that covers cooperation, judicially and legally, in civil and commercial laws and personal status law and exchange of legal information applicable in both countries. The said agreement will deal with facilitating the right of litigation for citizens before courts in both countries; recognizing court judgments, formal contracts, and the awards of arbitrators as well as extraditing criminals. The Yemeni delegation will visit “The Institute of Judicial and Legal Studies” to learn about the method of study followed in the Institute and to what extent the scholars may benefit from the judges and justices who deliver lectures in the Institute. In addition, Al-Hariti will meet the Iranian Minister of Justice and the delegation accompanied to him in order to prepare for signing an agreement of security between both countries, as such visit should have been conducted a month ago but it was inaccessible due to the political conditions in Kuwait. It is intended that both Ministers will discuss several legal matters before dealing with concluding this agreement. On the other hand, Al-Hariti sent a telegram to his Lebanese counterpart “Ibrahim Nagar” to ask about him and his wife as they were exposed to a traffic accident on the maritime road between Beirut and the city of Jouneih. Al-Hariti expressed his wishes for complete recovery in order to proceed his ministerial jobs as well as undertake his new office as a head of “The Council of Arab Justice Ministers”, which Al-Hariti handed over to him after he returned from Beirut two weeks ago.

   The Minister of Justice and Social Affairs and Labor Jamal Shehab has promulgated a decree for the formation of a high commission for human rights, the Council of Ministers had already commissioned, the Ministry of Justice on Sept 12, 2004 to establish a commission to study the human rights reports issued by international committees and organizations, and the Ministry of Justice shall follow-up the reports. The decision to restructure the Commission by the Ministry of Justice came in response to the proposal of the Committee for Defending Human Rights in the pervious national assembly, which agreed at its meeting on November 20, 2006 to this proposal.

   The assistant Undersecretary of the information technology and Statistics sector in the Ministry of Justice Mr.Mohamed Al-rumaih met in his office a judicial delegation from Lebanon included the head of the Beirut execution Chamber and adviser to the Lebanese Minister of Justice Judge waSim hajar and the Director of the Department of Information Systems Engineer Omar al-Aqeeli. During the meeting they exchanged of judicial information, the delegation also listened to a briefing on the functions of the information technology and statistics sector, and its departments and the services it provides, in addition to considering the strong brotherly relations between Kuwait and Lebanon and ways of strengthening these relations. The delegation visit will last till today and will include the Palace of Justice to hear the technical explanation of the judicial information system, which relates both to public prosecution and the courts and the civilian execution.

The head of the Cultural Committee of the Kuwaiti Lawyers Association and Chairman of the Organizing Committee for the cultural events week legal advisor Falah Al-Hajrav said that the week includes a special legal books exhibition the third of its kind, involving more than 30 publishing houses from all the Arab and Gulf states.

  Minister of Justice and Social Affairs and Labor Jamal Shehab ,Said that there are essential factors must be provided in order to encourage investment in our country and create ways to achieve the desired results, and comes in the forefront activating the legal system of judicial arbitration as an alternative to resort to the ordinary courts in investment disputes, which may take long time in considering actions and dispute, which impedes the process of investment, which requires speed decision  in this conflict.

   The member of Supreme Council of judiciary and Under-Secretaryof the Ministry of Justice Sultan Bursli said yesterday, that Kuwait attached great importance to encourage investment and take arbitration as an optional method to resolve disputes in addition to the ordinary courts for many years. Bursli's words came in a speech delivered on behalf of the Minister of Justice and Social Affairs and Labor and the representative of His Highness the President of the Council of Ministers host of the «arbitration role in encouraging investment» convention, which opened yesterday and lasts three days. Bursli explained that in the year 1995 the Arbitration Act was issued, which is considered a pioneer experience and idea in the field of arbitration as a mean to eliminate parallel in resolving disputes in support of this new system, where the Kuwaiti legislature stated to adopt it in the law of organizing investment of foreign capital.

   The Assistant undersecretary of Information and citizen service centers in the Ministry of Justice Salah Yousif Ben Ali declared of opening a new centre to serve the citizen in Doha soon. Ben Ali told al roeiya that the new Centre will provide al services provided by other centers in various regions and governorates of Kuwait through coordination and cooperation with other Ministries in the State, in the forefront the ministry of Interior and Defense, also provided by cadres qualified to provide legal services to the auditors of the centers.

   The Minister of Justice and Social Affairs and Labor Jamal Shehab received at his office Imad Yassin al-Harbi a legal specialist in labor sector ,where he presented his Masters in Public Law, which was entitled the guarantees of constitutional judicial independence and this is considered as the first Master's by a legal Kuwaiti in this specialization. The minister praised the study and gave him his congratulations and wished him success.

   Kuwaiti committee composed of several ministries in Cairo is discussing problems of the Kuwaiti people from non Kuwaiti mothers and working to overcome the difficulties they face in accordance with the decision of the Kuwaiti ministries’ council. The Committee members told the Kuwait News Agency (KUNA) that their work is primarily humanitarian and that the formation of the committee is made by a Kuwaiti humanitarian gesture for the sake of their sons abroad who stumbled by circumstances and reasons that have prevented them from issuing their personal identification papers. The advisor at the Ministry of Foreign Affairs Abdullah Al Sharhan said that the committee is composed of a team comprising the ministries of Social Affairs and labor, Foreign Affairs, Interior, Health and Justice.

   The Undersecretary of the Ministry of Justice Counsel Sultan Bursli assured that the goal of the Ministry of Justice of organizing the convention for the role of arbitration in investment promotion, which is scheduled to start March 24 which gives the opportunity to get acquainted with the Arab and international arbitration systems and direct contact with the relevant local, Gulf, Arab and international levels in order to know the multiple aspects  of Arbitration and its benefits achieved for investment promotion ..     Al-Shehab issued a ministerial resolution to form Supreme preparatory  committee for the follow up and the organization of the conference chaired by the under secretary of the Ministry of Justice Councilor Sultan Bursli and membership of Undersecretary of the Ministry of Justice for International Relations d.    The Ministry of Justice is organizing an international conference under the title «role of arbitration in investment promotion» auspices of His Highness the Prime Minister Sheikh Nasser Al-Mohammadal- Sabah, during the period from 24 March till  26 of this month, said Minister of Justice and Minister of Social Affairs and Labor Jamal Shehab: that the Conference would be attended by heads of arbitration centers at the local, Gulf, Arab and international level  representatives of many commercial arbitration centers from various countries of the world in addition to the participation of a select group of senior professionals in law and arbitration and representatives of the Ministries of Justice in the GCC states.

  The appointed Undersecretary of the Ministry of Justice Abdul Aziz Al-Abdullah has issued an administrative resolution for delegating Ibtisam al Dweela observer of studies and research in Kuwait Institute for Legal and Judicial Studies, for the chairmanship of the Office of Legal Information Network (Glin) and this resolution comes in implementation of the Minister of Justice and Social Affairs and Labor Jamal Shehab decision on establishment of the office and raise it to the level of control in order to effectuate the role of the network and expand its work and achieve the objectives contained in a cooperation protocol signed between the Ministry of Justice and the American Library of Congress in 1995 and the adoption of Kuwait as a regional centre for Global Legal Information Network for the Middle East countries.

    In accordance with its strategies of Bringing services within its justice to all citizens and to allow the litigants and the general auditors to complete their transactions during the morning and afternoon shifts in addition to alleviating the pressure on the Palace of Justice and other courts complexes, Ministry of Justice opened a new center to serve citizens in Sabhan providing various services related to judicial proceedings and other justice bodies and within the Participation in the Centre of the Ministry of Defense and representatives of the ministries of state including internal and external communications, electricity and energy, municipal and civil information authority along to the Gulf Insurance company and the National Bank of Kuwait.

   Said the Minister of Justice and Minister of Social Affairs and Labor Jamal Shihab ,justice in Kuwait is on the right track and that the judicial authority is independent, pointing out that what was referred to  regarding  corruption perceptions index did not mean corruption of the judicial authority, but corruption in broader sense, he said that corruption affects any person, whether he was small official or director or a minister or deputy and it is important that there be individual control within oneself and  a certain system that reveals financial disclosure since the beginning of his career  until its end. Pointing that financial disclosure law is under study. And Regarding Kuwait establishing an independent human rights committee said that this is a natural matter, where Kuwait is a State of law and preserve rights and freedoms and the existence of an independent human rights committee is important and necessary.

    The Minister of Justice and Minister of Social Affairs and Labor Jamal Shihab said today that the government devote all its energies to ensure the quality of public service through the rule of law and the embodiment of integrity, transparency and accountability. Shahab added in the opening of Kuwait’s second Transparency Forum, organized by Transparency Society under the banner of (public service reform), under the patronage of His Highness the Emir of Kuwait, Sheikh Sabah Al-Ahmad Al-Sabah said that the talk about indicators of corruption must be borne in mind with the practice of democracy standard where it is a positive indicator for those States in particular, that publicly raised the issues of corruption and all which is not found in other countries where information is concealed and  lacks the courage.

   Ministry of Justice announced that the Board of Trustees of the Global Legal Information Network(Glin) in the American Library of Congress decided to choose Abdullah Al-Qahtani head of Glin office in the Ministry of Justice as a member and Vice Chairman of the Board  after his victory in the elections conducted by the Trustees Centre of the network at their last meeting in Washington, and as  confirmation of the central and vital role of the State of Kuwait in support of the network and the continuation of connection and the permanent and persistent efforts by the promotion of network services, programs and tireless quest to strengthen its position in the Middle East. And Dr. Robbins Medina Librarian Congress and the chairman of the Executive council of Glin had urged in writing addressed to the Ministry of Justice as the headquarter for the network in the Middle East to invite countries in the region to join the network and make use of legal information offered by Glin.

    The Minister of Justice and Social Affairs and Labor Jamal Shehab issued a ministerial resolution for the establishment of the "human rights" in the Ministry of Justice that aims to support and promote human rights in the State of Kuwait and to uphold its position in all international forums by reviewing international conventions relating to human rights, and seek for the possibility of its association with the State of Kuwait if there  were not any reservations and comment on these reservations, before recommending ratification or accession of the State of Kuwait and review projects of bilateral or multilateral human rights agreements and what is  received of reservations, as well as the proposal to avoid shortcomings in the Legislation based on those rights

    Collection of 3 million dollars for the interests of the state from one of foreign companies -The Undersecretary of the Ministry of Justice, Advisor Sultan Bursli declared the collection of judicial fees for the interest of the state treasury of more than 3 million dollars in judgments issued by the Kuwaiti courts against one of the companies abroad.

   Arab Ministers of Justice discuss the Conventions against terrorism and money laundering – the state of Kuwait is heading the 23rd round  twenty of the Council of Arab Ministers of Justice, which begins its work tomorrow, Tuesday, at the headquarters of the Arab League in Cairo, Kuwait is represented in the Conference by the Minister of Justice and Social Affairs and Labor affaires Mr. Jamal Shihab, whom emphasized in a press statement that the Arab Justice Ministers will discuss a number of topics of judicial and legal Forefront the Arab Convention for combating terrorism and its implementation mechanism and the Arab Convention for combating money laundering and the financing of terrorism and to strengthen Arab cooperation in that regard.
