Ministry of Justice - state of Kuwait. Kuwait is independence Arab state. Its
constitution has organized precisely the state's powers.
It stipulates that the three powers legislative, Executive and
Judicial are ruling all the powers in the state .
As Judiciary is one of these three powers, The constitution
emphasizes on keep it run by competent Judges who are only governed by their
conscience and law, and that their integrity and justice constitute the basis of
ruling and secure the rights and freedoms.
The state of Kuwait has been keenly desirous in its modern
history, after it took up its place among the civilized world countries and
after the considerable expansion of its business and investments locally and
abroad, to enact and promulgate all legislation which govern the civil and
commercial transactions and dealings in light of the most contemporary
international lawful theories in order to control the said transactions and
safeguard the rights of parties involved, besides emphasizing the basis of those
transactions in terms of ethics of profession, honest dealings and good faith .
So that the rightful suitor may get his right in the shortest possible time and
by easier means .
From these legislation which prove the said principles are
those of Arbitration. The state of Kuwait has been so keen to organize
Arbitration. It established the Judicial Arbitration Dept. In Ministry of
Justice under the law No. 11/95 being by this the only specialized authority
which controls and observes the Judicial Arbitration system. This system is
running by Arbitration panels which had been established specially to keep the
basic advantages and principles of Arbitration like secrecy, speed up the
lengthy processing of disputes, less charges and other important advantages.
